Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the HealthSimple application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Random Hit LLP, the operator of HealthSimple.

2. Eligibility

• You must be at least 13 (or 18 in India, unless with verifiable parental consent) to use this App.
• You must provide accurate registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not create accounts for others without their explicit consent.

3. Description of Service

HealthSimple is an AI-powered informational health companion. The App provides:

• Medical report analysis: Plain-language AI summaries of uploaded lab and diagnostic reports, highlighting normal, borderline and critical values with suggested precautions.
• Medicine information: AI identification of scanned medicines, with information on uses, dosage, side effects, pros, cons and warnings.

Both features support multilingual output across major Indian languages and English. All outputs are AI-generated summaries for informational purposes only.

4. Prohibited Uses

• Diagnosing, treating, curing or preventing any medical condition
• Replacing professional medical consultation or emergency medical care
• Uploading documents or images you don't have permission to use
• Uploading content that violates third-party privacy rights
• Reverse-engineering, decompiling or extracting the App's AI models or source code
• Creating fake accounts or impersonating others
• Using the App to violate applicable laws in India or the USA
• Distributing, reselling or commercially exploiting outputs without consent

5. Intellectual Property

All content in the App — including the HealthSimple name, logo, design, AI models, summaries and software — is the exclusive intellectual property of Random Hit LLP, protected under Indian copyright law (Copyright Act, 1957) and applicable US laws.

You retain ownership of documents and images you upload. By uploading, you grant us a limited, non-exclusive license to process your content solely to provide the App's services.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, including accuracy of AI-generated summaries, fitness for a medical purpose, or uninterrupted service. HealthSimple does not warrant that any information is medically accurate or suitable for any individual's specific health condition.

7. Limitation of Liability

To the maximum extent permitted by law, Random Hit LLP and HealthSimple shall not be liable for medical decisions made based on App outputs, inaccuracies in AI-generated information, loss of data or health outcomes, or any indirect, incidental, special or consequential damages. Your use of the App is at your own risk.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Sri Ganganagar, Rajasthan. US users retain rights under applicable state and federal consumer-protection laws.

9. Dispute Resolution

Both parties agree to attempt good-faith resolution before formal proceedings. Disputes that cannot be resolved informally may be submitted to arbitration under the Arbitration and Conciliation Act, 1996, in Sri Ganganagar, Rajasthan.

10. Termination

We may suspend or terminate your account for Terms violations. You may delete your account at any time. Upon termination, data is deleted per our retention policy within 30 days.

11. Modifications to Terms

We may modify these Terms with at least 7 days' notice through the App. Continued use after the effective date constitutes acceptance.
